1. Acceptance of These Terms

By accessing this website, submitting a request, creating an account, making an online payment, or enrolling in a maintenance plan, you agree to these Terms of Service and our Privacy Policy. Do not use the site or online services if you do not agree.

2. Website and Account Use

You agree to provide accurate information, use the website only for lawful purposes, and avoid conduct that interferes with site security, operation, or other users.

You are responsible for activity under your customer account and for protecting your login credentials. Notify Air Innovations promptly if you suspect unauthorized access.

3. Service Requests and Scheduling

An online form, call, text, chat, account request, or scheduling submission is a request for service and does not by itself create a confirmed appointment or require Air Innovations to accept the work. An appointment is confirmed only when Air Innovations communicates confirmation.

Arrival windows and completion estimates are reasonable projections, not guarantees. Weather, traffic, emergency calls, equipment availability, job conditions, and earlier appointments may affect timing.

Air Innovations may decline, postpone, or stop work when conditions are unsafe, outside our scope, legally restricted, or materially different from the information provided.

4. Estimates, Pricing, and Payment

Website descriptions and general pricing information are not binding job quotes. Final scope and pricing may depend on diagnosis, system condition, accessibility, code requirements, permits, equipment selection, and other job-specific factors.

Estimates are based on visible and reasonably discoverable conditions. Additional work or materials require customer authorization when practical. Payment is due according to the applicable estimate, invoice, checkout page, financing agreement, or written service terms.

Online payments may be processed through Wix and third-party payment providers. Those providers may impose additional terms. A failed, reversed, or disputed payment does not eliminate the underlying amount owed for authorized work or services.

5. Customer Responsibilities

The customer agrees to:

• Provide accurate system, property, access, and contact information.
• Provide safe and reasonable access to the property and HVAC equipment.
• Secure pets and disclose known hazards, contamination, water damage, electrical concerns, access limitations, or unsafe conditions.
• Have authority to approve work at the service property.
• Review estimates, invoices, operating instructions, and warranty requirements.
• Maintain utilities and property conditions reasonably necessary for testing and service.

6. Maintenance-Plan Terms

Air Innovations maintenance plans are intended for preventative HVAC care. Unless a written plan states otherwise, the following terms apply:

• Each HVAC system requires its own active subscription or included system position.
• Plans include two seasonal maintenance visits each plan year: one cooling visit and one heating visit.
• Priority scheduling means priority over comparable non-plan requests when reasonably available; it is not a guaranteed arrival time or immediate response.
• The 10% repair discount applies only to eligible repair work while the applicable plan is active and in good standing.
• Maintenance visits are subject to technician availability and reasonable scheduling.
• Preventative maintenance does not include repairs, replacement parts, emergency service, code corrections, equipment replacement, refrigerant, or work not expressly included.
• Missed, declined, or overdue payments may suspend visits, discounts, priority benefits, account access, or other plan benefits.
• Plans are tied to the original service address and enrolled HVAC system or systems unless Air Innovations approves a transfer in writing.
• Enrollment is a 12-month service commitment even when billed monthly.
• Cancellation must be requested directly in writing. Early cancellation does not waive the remaining committed plan balance and does not create a refund of amounts already paid.

The selected plan name, price, number of enrolled systems, checkout terms, and any written enrollment documents are incorporated into these Terms.

7. Equipment and Workmanship Warranties

Manufacturer warranties are provided by the applicable manufacturer and are subject to its registration, maintenance, ownership, transfer, and claim requirements.

Any Air Innovations workmanship or labor warranty applies only when stated in writing on an estimate, proposal, invoice, or warranty document. Unless expressly stated in writing, no additional warranty is created by website content, advertising, discussions, or these Terms.

Warranty coverage may exclude misuse, abuse, lack of maintenance, clogged filters or drains, power problems, weather, flooding, pests, alterations, work by others, pre-existing conditions, and conditions outside Air Innovations’ control, subject to applicable law and the written warranty.

8. Emergency-Service Requests

Air Innovations accepts requests for emergency HVAC service, including after-hours requests. Availability, response time, and acceptance depend on technician availability, location, safety, workload, weather, and the nature of the problem. The website and phone availability do not guarantee an immediate response.

For fire, suspected gas leaks, carbon-monoxide alarms, electrical arcing, medical emergencies, or other immediate threats, leave the area when appropriate and contact 911, the utility provider, fire department, or other qualified emergency authority.

9. Website Information and HVAC Guidance

Website articles, FAQs, checklists, descriptions, and troubleshooting information are general educational information. They are not a substitute for an on-site diagnosis and should not be relied upon where safety, refrigerant handling, electrical work, combustion equipment, code compliance, or equipment damage may be involved.

10. Third-Party Services and Links

The site may use or link to Wix, payment providers, Google, social-media services, review platforms, financing providers, manufacturers, or other third parties. Air Innovations is not responsible for third-party websites, availability, content, policies, security, or separate contractual terms.

11. Intellectual Property

The Air Innovations name, logo, branding, website design, original text, graphics, photographs, and other site materials are owned by or licensed to Air Innovations and may not be copied, republished, sold, or used to imply endorsement without written permission, except as allowed by law.

12. Disclaimers and Limitation of Liability

To the maximum extent permitted by law, the website and online features are provided on an “as available” basis. Air Innovations does not guarantee uninterrupted website operation, error-free content, specific search-engine placement, or the availability of any particular online feature.

To the maximum extent permitted by law, Air Innovations will not be liable for indirect, incidental, special, exemplary, or consequential damages arising solely from use of or inability to use the website or third-party online services.

Nothing in these Terms limits liability that cannot legally be limited or changes rights provided by a signed proposal, written warranty, invoice, or applicable consumer-protection law.

13. Governing Law

These Terms are governed by the laws of the State of Louisiana, without regard to conflict-of-law principles. Any dispute concerning these Terms or website use shall be brought in a court with lawful jurisdiction in Louisiana, unless applicable law requires otherwise.

14. Changes to These Terms

Air Innovations may update these Terms as the website, services, plans, providers, or legal requirements change. Updated Terms become effective when posted with a revised effective or last-updated date, unless a later date is stated.
